1. Agreement and operator
These Terms and Conditions (“Terms”) govern your access to and use of the BetterShot iOS app, website, account, photo-coaching and image-enhancement features, and related services (together, the “Service”).
The Service is provided by OdO Holding B.V., established in the Netherlands, trading as BetterShot (“BetterShot,” “we,” “us,” or “our”). You can contact us at info@bettershotapp.com.
By creating an account, you agree to these Terms. If you use BetterShot without an account, the provisions that relate to your use of the Service still apply. Our Privacy Policy separately explains how we process personal data; it is not part of these Terms.
2. Eligibility and accounts
You must be legally capable of entering into these Terms. If you are under 18, your parent or legal guardian must authorize your use and these Terms. BetterShot is not intended for children under 13.
You must provide accurate account information and keep it current. Keep your credentials secure and tell us promptly if you suspect unauthorized access. You are responsible for activity through your account except where it results from a failure attributable to us.
The Service is intended primarily for personal use. If you use it for business purposes, consumer protections may not apply to that use.
3. The BetterShot service
BetterShot provides tools intended to help you take, assess, edit, and enhance photographs. Features may include camera guidance, automated photo analysis, and AI-assisted image processing. Some features require a supported Apple device, a compatible version of iOS, an internet connection, an account, permission to process a selected photo, or a paid subscription.
We will provide the Service as described in the app and purchase screen and with the quality, functionality, compatibility, continuity, security, and updates required by applicable law.
BetterShot is a creative tool. It does not provide professional, medical, legal, safety, or other expert advice.
4. Your photos and instructions
You keep the rights you have in photographs, prompts, instructions, and other material you submit to BetterShot (“User Content”).
You give us a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, adapt, and process User Content only as reasonably necessary to provide the feature you request, operate and secure the Service, troubleshoot and support it, enforce these Terms, or comply with law. This licence ends when it is no longer needed for those purposes, subject to legal retention obligations and the periods described in our Privacy Policy.
You confirm that you have the rights and permissions needed to submit and process User Content. You must respect copyright, portrait and publicity rights, privacy, confidentiality, and data-protection law. If a photograph contains another person, you are responsible for having an appropriate basis to take, process, use, and share that image.
We do not use photos submitted to BetterShot to train our own AI models. Our Privacy Policy explains which providers process photos and for how long.
5. AI-assisted features
AI-assisted results depend on the photograph, your choices, technical conditions, and probabilistic systems. A result may contain errors, artifacts, omissions, or unexpected changes, may differ between requests, and may not be unique. Inspect every result before relying on, publishing, printing, or sharing it.
We do not claim ownership of an output generated specifically for you. To the extent we hold transferable rights in that output, we grant those rights to you when it is created. This does not transfer rights in BetterShot’s software, interfaces, models, designs, workflows, or branding.
We do not promise that an output qualifies for copyright protection or that using it cannot affect another person’s rights. Restrictions attached to your source material, third-party material, or applicable law continue to apply to the output.
6. Acceptable use
You must not use the Service to:
- break the law or infringe another person’s rights;
- create or process child sexual abuse material, sexual exploitation of a minor, or non-consensual intimate imagery;
- impersonate, deceive, defraud, threaten, abuse, or unlawfully discriminate against another person;
- promote serious violence or criminal activity;
- upload malware, disrupt the Service, probe it for vulnerabilities, or bypass its security, safety, usage, or access controls;
- access another person’s account without permission;
- scrape or systematically extract the Service or its outputs, use unauthorized automated access, or reverse engineer the Service except where mandatory law permits it; or
- resell the Service or use systematic extraction of outputs to build or train a competing model or service, except where such a restriction is prohibited by law.
We may reject a processing request or take proportionate action against content or an account when reasonably necessary to address fraud, abuse, illegal material, a security risk, or a breach of these Terms.
7. Subscriptions and App Store billing
Some features require a paid subscription. Before purchase, the paywall shows the subscription, included features or allowances, billing period, total price, any free trial, and renewal terms. Feature allowances have no cash value, cannot be transferred, and renew or expire as described on the purchase screen.
Purchases in the iOS app are processed through Apple’s In-App Purchase system under the terms associated with your Apple Account. Apple manages payment authorization, collection, billing records, and its refund interface. We do not receive your full payment-card details.
An auto-renewable subscription renews unless you cancel it before renewal. You can manage or cancel it in your Apple Account subscription settings. Cancellation stops a future renewal but does not automatically refund the current billing period. Deleting your BetterShot account or app does not cancel an Apple subscription.
If a free trial is offered, the paywall states its duration and the amount charged afterward. Unless you cancel before it ends, the trial converts to the displayed paid subscription. Prices may change only in accordance with applicable law and Apple’s rules, including any required notice or consent.
8. Withdrawal, cancellation, and refunds
If you are a consumer in the European Union or European Economic Area and enter into a distance contract, you normally have 14 days to withdraw without giving a reason, subject to statutory exceptions.
For a service that you expressly ask to begin during that period, you may have to pay a proportionate amount for service already supplied if you later withdraw. For digital content supplied without a physical medium, you lose the withdrawal right only when all legal conditions have been met, including prior express consent to immediate supply, acknowledgement of the loss of the right, and the required confirmation.
For an App Store purchase, submit charge, refund, or withdrawal requests using Apple’s purchase-support process. You may also contact us at info@bettershotapp.com. A clear statement that identifies you, the purchase, its date, and your decision to withdraw is sufficient.
These rights are separate from turning off automatic renewal. Nothing in these Terms restricts mandatory rights relating to non-supply, lack of conformity, repair, replacement, a price reduction, termination, or reimbursement.
9. Our app and intellectual property
The Service and its software, designs, branding, text, interfaces, models, workflows, and other materials are owned by BetterShot or its licensors and protected by intellectual-property law.
Subject to these Terms and Apple’s applicable licence terms, we give you a limited, personal, non-exclusive, non-transferable right to use the Service for its intended purpose for as long as your account or subscription permits.
The iOS app is licensed, not sold. Apple’s Standard Licensed Application End User License Agreement governs the licence to the app. These Terms supplement that licence by governing your BetterShot account and Service. The BetterShot service contract is between you and OdO Holding B.V., not Apple.
10. Privacy and third-party services
The Service relies on providers for functions such as App Store distribution and billing, authentication, hosting, analytics, subscription management, and AI processing. Their own terms may apply when you interact directly with them. Our use of a supplier does not remove responsibilities that applicable law places on us.
Our Privacy Policy describes how BetterShot and its providers process personal data, including submitted photos. Permission for optional processing or device access is requested separately where required.
11. Updates and changes
We may update the Service to maintain security and legal conformity, adapt to technical environments, prevent misuse, or improve functionality. Install updates within a reasonable time after we make them available and explain their importance.
For a digital service supplied over time, we will make other changes only for a valid reason, without additional cost to you, and as permitted by applicable law. If a change negatively affects your access or use beyond a minor degree, we will give reasonable advance notice on a durable medium and explain any right to terminate without charge.
We may update these Terms for similar legitimate reasons. We will provide reasonable notice of material changes and will not retroactively reduce rights you have already accrued. If required by law, we will ask you to accept the revised Terms.
12. Suspension and termination
You may stop using BetterShot and delete your account in the app at any time. Before deleting it, save any outputs you want to keep. Account deletion does not cancel an App Store subscription.
We may proportionately restrict or suspend access for a material or repeated breach of these Terms, fraud, illegal use or material, a security threat, non-payment, or a legal requirement. Except in urgent cases, we will give reasonable notice and an opportunity to remedy a remediable breach. Contact info@bettershotapp.com to challenge a restriction.
We may discontinue all or part of the Service with reasonable notice. Where mandatory law requires it, we will provide an appropriate remedy and an opportunity to retrieve eligible content.
13. Conformity, availability, and liability
Your mandatory rights concerning digital content and digital services remain unaffected. If the Service is not supplied or does not conform to our contract, you may be entitled to have it brought into conformity, receive a proportionate price reduction, terminate the contract, or receive a refund, depending on the circumstances.
We do not promise that the Service will always be uninterrupted or error-free. Maintenance, security incidents, internet or platform failures, and events outside our reasonable control may temporarily affect availability. This does not reduce obligations that cannot legally be excluded.
To the extent permitted by law, we are responsible for direct and reasonably foreseeable loss caused by a failure attributable to us. We are not responsible for loss caused by unlawful or unauthorized User Content, use contrary to the stated purpose or these Terms, or your failure to install an update after we clearly informed you of its availability and the consequences of not installing it.
For business use, and only to the extent permitted by law, we exclude liability for indirect or consequential loss and loss of profit, revenue, opportunity, goodwill, or business data. Nothing excludes or limits liability where doing so is unlawful, including for intentional misconduct, deliberate recklessness, fraud, or mandatory consumer remedies.
14. Complaints, governing law, and disputes
Send complaints to info@bettershotapp.com with enough information for us to identify the issue and any relevant account or purchase. We will respond within a reasonable time.
These Terms are governed by Dutch law. If you are a consumer, this choice does not deprive you of mandatory protections in the country where you habitually live. You may bring a claim before any court that has jurisdiction under applicable consumer law. We will bring proceedings against a consumer only where that law permits.
If you live in another EU or EEA country, you may also ask your local European Consumer Centre for assistance. We encourage you to contact us first, but doing so is not a mandatory arbitration or dispute-resolution requirement.
15. General terms and contact
If part of these Terms is invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision immediately does not waive it.
We may transfer our rights and obligations as part of a merger, reorganization, or sale only where this does not reduce your rights. You may not transfer your account without our consent except where mandatory law permits it.
Sections that by their nature should continue after termination—including provisions about ownership, accrued obligations, liability, and disputes—remain effective.
